Former governor of Kaduna State, Nasir El-Rufai, has said the Federal High Court has no business meddling in chieftaincy issues outside of the Federal Capital Territory, FCT.
El-Rufai congratulated the Emir of Kano, Muhammad Sanusi, over the judgement of the Appeal Court, which nullified the order of the Federal High Court in the Kano State Division.
The Kano Federal High Court had nullified Sanusi’s appointment following an emirate tussle in Kano State.
The order nullifying Sanusi’s appointment was issued by Justice Abubakar Liman of the Kano Division of the Federal High Court on June 20, 2024.
However, a three-man panel of justices of the Court of Appeal on Friday in Abuja held that the order of the lower court was a nullity because it had no jurisdiction to dabble into the Kano Emirate’s legal battle.
Justice Abdul Dogo, in one of the judgements, held that the Federal High Court proceeded in error when it erroneously turned a chieftaincy matter into a fundamental rights enforcement case, as claimed by Alhaji Aminu Babba Dan Agundi, an appellant in the fierce legal battle.
