Prominent human rights lawyer Femi Falana (SAN) has called on Inspector-General of Police Kayode Egbetokun to ensure law and order during the upcoming Local Government Area (LGA) elections in Rivers State, scheduled for October 5, 2024.
According to Vanguard, this plea comes despite a recent Federal High Court ruling prohibiting police participation in the elections.
In a letter to the Rivers State Police Command, written on behalf of the Rivers State Independent Electoral Commission (RSIEC), Falana emphasized that an appeal has been filed against the September 30 ruling by Justice P.O. Lifu, alongside a motion for a stay of execution.
He noted that legal precedent indicates that parties should maintain the status quo while awaiting the court’s decision.
Falana referred to the Supreme Court’s ruling in Mobil Oil Nigeria Limited v. Assan (1995), asserting that the police would not be in contempt if they maintain order during the elections.
He also cited a related Rivers State High Court decision instructing RSIEC to conduct the elections in accordance with earlier Supreme Court directives.
Concerns were raised regarding threats from individuals intending to disrupt the elections.
Falana urged the Rivers State Police Commissioner to implement measures to safeguard voters and uphold democratic rights.
