The death of 43-year-old D’Vontaye Mitchell, an unarmed Black man, while being restrained by security guards at a Milwaukee Hyatt Regency on June 30, has been officially ruled a homicide, according to the medical examiner’s report released Friday.
The report confirms that Mitchell died from asphyxia due to the restraints and from the effects of cocaine and methamphetamine intoxication.
The case has sparked significant outrage and protests from Mitchell’s family, who have drawn parallels to the George Floyd case and called for the guards involved to face charges.
The Milwaukee County District Attorney’s office has yet to decide on filing charges, as it awaited the medical examiner’s findings.
The report also notes that Mitchell’s death was exacerbated by hypertensive cardiovascular disease and morbid obesity.
Surveillance footage reportedly shows Mitchell being physically abused by hotel staff while he was restrained and unresponsive.
