Judge Tanya Chutkan has scheduled a hearing for Aug. 16 at 10 a.m. in former President Donald Trump’s federal election interference case, though Trump is not required to attend. This marks the first appearance in Chutkan’s courtroom in seven months.
She denied Trump’s motion to dismiss the case on statutory grounds but allowed for refiling once issues of presidential immunity are resolved. The case was paused while Trump’s legal team appealed the issue to the Supreme Court, which ruled last month that a president has absolute immunity for core constitutional acts.
Chutkan will now determine whether Trump’s actions related to the 2020 election fall under “official acts” or private conduct subject to prosecution.
Trump, who has pleaded not guilty to charges of attempting to overturn the 2020 election results, initially faced a March 4 trial date before the appeal delayed proceedings.
