The fund@mental hum@n r1ghts are contained in the Constitution of Nigeria and must be respΒ£cted by all persons (including landlords and tenants). Among the fund@mental human rights are the Right to dignity of human person (this fr0wns against inhum@n and degr@ding treatmΒ£nts) and the Right to @cquire and own immovable property.
Contr@ry to the leg@lly approved means of ev!cting tenants (seeking and obtaining v@lid court orders), some landlords and their agents f0rce tenants out of their property. Some go as far as, removing roofs, renovating the property or conn!ving with government sanitation/environmental protecti0n offices in order to frustr@te tenants.
The moment there is tenant on a property, the landlord and his agents have only l!mited r!ghts to enter or work on the property with consent. The consent of a tenant must be sought and obtained before his roof can be removed or any renovation, that will cause him distrΒ£ss/h@rdship can be commenced. Tenant can suΒ£ landlord and his agent for tresp@ss. Tenants should not be f0rcefully thrown into rain/sun or !nsecurity due to removed roof or renovation; this will be degr@ding and inhum@ne. The tenantβs right to d!gnity of person must be respΒ£cted by landlords.
