The Federal High Court Abuja division has affirmed the emergence of Ahmed Usman Ododo as the Governorship candidate of the All progressive Congress for Kogi state in the forthcoming Governorship election slated for November,
The presiding Judge, Justice James Omotoso gave the order in a preelection matter filed by Senator Smart Adeyemi and some other aspirants that participated in the APC Governorship primary election.
Justice Omotoso dismissed the suit for lacking in merit.
The court held that the plaintiffs needed to prove the allegations of forgery, falsification of results, beyond reasonable doubts.Â
The court equally pointed out that the burden rests on the to produce the alleged forged result or the original to discharge the burden, holding that failure to discharge the burden was fatal to the case of the plaintiffs.”Â
Justice Omotoso held that having reviewed all the evidence in the matter, the court had no doubt that the APC primary election result held in all the wards of Kogi state on the 14TH APRIL, 2023.Â
meanwhile, one of the plaintiffs in the matter, Senator Smart Adeyemi has signified the intention to appeal the verdict of the trial court
